On February 25, 2020, Branch 4 of the Prosecutor’s Office of the Public and Revolutionary Court of Eslamshahr County convened for a scheduled extraordinary session to review Case No. 9809982882401169. The session was presided over by the undersigned investigator. After conducting investigations and reviewing the case documents, the undersigned investigator announces the conclusion of the investigations. With reliance upon God Almighty and based on honor and conscience, the investigator issues the following ruling:

Order of Non-Prosecution

Following the report of law enforcement officers and the complaint filed by Reza Salmanzadeh and Nasrin Darabi against an unidentified individual for intentional murder, the case proceeded to investigation. However, the forensic examination of the body did not reveal any signs or evidence of a physical altercation between the deceased and any other person(s). Local inquiries did not produce any testimony indicating noise or disturbance suggestive of a fight. Due to the insufficient evidence to prove a crime and based on the presumption of innocence, an Order of Non-Prosecution is issued in accordance with Article 265 of the 2014 Code of Criminal Procedure and subsequent amendments. According to Paragraph (a) of Articles 270 and 271 of the aforementioned law, the complainant may appeal this order within ten days of notification to Criminal Court Branch 1 of Eslamshahr County. The office is instructed to paginate the case file and present it to the honorable prosecutor today for approval, in compliance with Articles 92 and 267 of the Code. If the prosecutor agrees, the order will be sent to the parties. After the legal deadline has passed and the case has been confirmed as final, it will be removed from statistics and archived. If the complainant files an appeal, the case will be referred to the competent court for adjudication, with the original preserved.

Greetings,

We, Reza Salmanzadeh and Nasrin Darabi, respectfully state that our case, registered under No. 981285 with Branch 4 of the Prosecutor’s Office, ultimately resulted in the issuance of a Non-Prosecution Order. I am objecting to the issued order and, considering the detailed evidence and documentation outlined below, I emphasize that I filed a complaint against an unidentified individual for the intentional murder of our child. All relevant evidence and documents are included in the case file, and our attorney will submit a supplementary statement. Despite these reasons and supporting materials, however, a non-prosecution order has been issued in response to my complaint. Therefore, we respectfully request a review of the case and, through this objection to the issued order, petition for the issuance of the necessary judicial directive to annul said order.
