The body of the above-mentioned subject, a 35-year-old man with an approximate height of 175 cm and a weight of about 80 kg, wearing outdoor clothes, was examined in the dissection room of the Forensic Medicine Department of Saqqez. The post-mortem rigidity was gone, and the lividity was present but lighter than normal in the posterior areas. There were no signs of decomposition. Based on the examination, the time of death was estimated to be within the last 12 hours. Examination of the head and face revealed two superficial wounds to the forehead and visible blood discharge from the nose and mouth. Impact wounds from two pellets were noted on the left side of the nose and the right side of the chin. No signs of pressure marks around the mouth and nose, congestion, hyperemia, or petechiae in the conjunctiva, nor any foreign body in the mouth or bone fractures were observed or palpable. The head and face were not congested. Examination of the neck revealed no visible signs of trauma, neck grooves, fractures, or dislocations of the cervical vertebrae. Examination of the torso revealed multiple pellet wounds to the anterior chest and abdomen, with a higher concentration on the right side. There were palpable rib fractures on the left side, probably from CPR. There were no visible fractures or dislocations of the sternum or spine. Examination of the upper and lower extremities revealed pellet wounds to the right hand, left inner arm, and both thighs. There were no signs of defensive wounds, electrical burns, or fractures. Examination of the genital and anal areas revealed no abnormal findings. The scalp was incised. Subcutaneous bruising was visible on the forehead area. The skullcap was removed. No signs of hemorrhage in the brain tissue, brainstem, ventricles, or between the meninges, nor any mass lesions within the skull were observed or palpated. The dura mater was severed. There were no fractures of the skull base. The body was opened for autopsy. The hyoid bone and thyroid cartilage were intact in the neck area, and no foreign body was found in the respiratory tract. Subcutaneous bruising was visible in the sternum and abdominal area. The sternum and parts of the costal cartilage were removed, revealing approximately two liters of blood in the right and left thoracic cavities. The right lung showed extensive contusion of the upper and middle lobes with multiple pellet punctures in these lobes. The left lung showed similar findings with extensive contusion in both lobes, with multiple pellet punctures in these lobes. Multiple pellets were removed for further evaluation. The pericardium was perforated and contained approximately 500 cc of blood. The heart was detached from its vascular base, and plaques were found in the aorta. Two puncture wounds were observed on the right ventricular wall. There were no abnormal findings in the coronary arteries or myocardium. The abdominal cavity was opened and showed no blood or abnormal fluid. Examination of the internal organs revealed bruising of the first segments of the small intestine and mesentery. The liver and spleen were normal in color, texture, and size. The stomach had normal mucosa and contained partially digested material. There were no perforations, foreign bodies, or ruptures in the intestines. Other internal organs in the abdomen were intact in their anatomical locations. The cause of death remains under investigation and a burial permit has been issued for the deceased.

The file does not specify which Special Unit officer fired the pellet gun that struck the decedent. Therefore, the assignment of responsibility and the identification of the perpetrator cannot be determined. Accordingly, regarding the public aspect of the case raised by the complainants (the next of kin), due to the lack of sufficient evidence, a non-prosecution order is hereby issued and announced, based on the presumption of innocence, Article 4, and under Article 265 of the Code of Criminal Procedure. According to the provisions of articles 270 and 271 of the aforementioned law, the decision can be appealed to the Military Court of Kurdistan within 10 days from the date of notification. However, based on the request of the interested party and considering the question of the innocence of the deceased, and given that the shooting of the deceased Fereidun Mahmudi by the officers of the Special Unit has been established before this authority - although the individual officer responsible cannot be identified - the issue of blood money (diya) must be adjudicated following Article 631 of the Code of Criminal Procedure. This should be handled by the military court without the need for a formal complaint.
