Case Summary:

According to the statements recorded on pages 81 to 83, the plaintiffs stated:

"Our son, Abolfazl Adinezadeh, was fatally shot on October 8, 2022, at approximately 11:30 a.m. near Mellat Park and the Ferdowsi University underpass in Mashhad. He died from a shotgun pellet wound. We therefore file a complaint against the military and law enforcement personnel assigned to the area and request a legal investigation."

Ms. Mahdieh Parsa'ian, a witness, stated on page 14:

"I was walking through the Mellat Park underpass on Vakilabad Boulevard when I noticed a young boy, about fifteen or sixteen years old, lying on the ground. People had gathered around him. I told them, 'Lift his legs.' A man responded, 'The police are asking people to leave the area and not gather. Several people supported the boy under his arms and tried to lift him up. As we helped him up, he suddenly collapsed again. With the help of bystanders, we carried him to Mellat Park and laid him on the grass. The boy appeared to be completely unresponsive. He had a few visible wounds on his side, but there was no significant bleeding. People around us said he had been hit by shotgun pellets. We placed him in a passing vehicle and drove him to the hospital.

Final Decision of the Prosecutor’s Office:

According to pages 95 through 101, the Commander of the Law Enforcement Forces of Khorasan Razavi Province stated the following:

"Some personnel of this unit were equipped with shotguns on the day of the incident; however, none of them discharged their weapons." Furthermore, according to page 106, the senior intelligence unit of the Islamic Revolutionary Guard Corps (IRGC) in Khorasan Razavi Province declared: "None of the IRGC officials present at the scene were armed with shotguns."

Prosecutor’s Decision:

Since no definitive or conclusive evidence proving the use of a shotgun by military or law enforcement officials has been obtained, the allegation is deemed unsubstantiated due to insufficient evidence. Therefore, pursuant to Article 265 of the Code of Criminal Procedure, I believe that the prosecution should be dropped. The complainants or their legal counsel may appeal the decision within ten days of official notification before the Military Court of Khorasan Razavi Province. Furthermore, in accordance with Article 85 of the Code of Criminal Procedure, the complainants will be advised to seek compensation (diyah) from public funds through the Public Court.
