About this Case

Captain Ali Akbar Atashin is one of 438 victims listed in the 13 March 1980 Amnesty International report. The report lists defendants who were convicted by Revolutionary Tribunals in the period from their inception until 12 August 1979. The list of victims and charges is drawn from sources including translations of indictments, reports of trials carried out by local and foreign media, and the bulletins of the official Fars News Agency reports.

International human rights organizations have drawn attention to reports indicating that the Islamic Republic’s authorities have executed individuals on trumped-up charges such as drug trafficking, sexual, and other criminal offences. The exact number of people convicted based on trumped-up charges is unknown. The story of his execution along with two others was also published in Kayhan daily on 23 April 1979.

Captain Atashin was an officer in the Joint Anti-Sabotage among S.A.V.A.K. (Sazman Ettela’at va Amniate Keshvar i.e. the National Organization of Intelligence and Security) and the Police Department (Kayhan).

Trial

Mr. Atashin’s trial along with two other defendants were the first session of the Revolutionary Tribunal in Mashhad. The trial took place in the former Hall of Rastakhiz Party in Mashhad and according to Kayhan, with the presence of 500 people of the victims’ families of the Pahlavi Regime. Considering one of the defendant’s hearing lasted 5 hours, and the subsequent verdict was issued at 8:30 p.m. of the same day, and regarding the fact that the other two verdicts were executed the next day at 4:30 a.m., it can be determined that his trial was very short (Kayhan).

Charges

According to Kayhan, Ali Akbar Atashin was charged with “torture in the prisons and hospitals during the time of the Pahlavi’s Regime”. He was also convicted of mass murder, repression, and corruption of the earth.

Evidence of guilt

There is no exact information regarding the evidence of his guilt but considering the report of Kayhan, there were some testimonies from medical doctors and nurses against the defendant.

Defense

No information is available regarding the defense of the accused or whether he was able to defend himself. The report of Kayhan only mentioned that he denied the charges against him. It is not clear from the newspaper report whether Mr. Atashin had the opportunity to defend himself effectively for example whether he had access to a lawyer or whether he had the opportunity to summon his witnesses and question the Prosecutor’s witnesses.

Judgment

The Revolutionary Tribunal of Mashhad found him guilty of mass murder, repression, and corruption of the earth along with the two other defendants; he was sentenced him to death. However, it is not clear of what he–individually–was found guilty. He was executed by shooting at dawn on 23 April 1979 along with two others.
