The documents below are related to a petition submitted to the “United Nations (UN) Working Group on Arbitrary Detention” on behalf of imprisoned political activist, Mr. Heshmatollah Tabarzadi. The petition was prepared and submitted by lawyers residing in the United States in coordination with the Abdorrahman Boroumand Foundation (ABF). The Working Group was established by a resolution of the UN Human Rights Committee, which was replaced by the UN Human Rights Council in 2006. The Working Group, a body of independent human rights experts that investigates cases of arbitrary arrest and detention that may be in violation of international human rights law, conducts field missions and expresses opinion on information submitted to its attention. The documents include a petition submitted to the working group on behalf of Mr. Tabarzadi against the Islamic Republic of Iran (15 August 2011) and the communications between the petitioners and the Iranian government (10 November 2011 and 14 November 2011). Following the communications between the parties, the Working Group came to the conclusion that Mr. Tabarzadi’s detention (since 2009) was arbitrary (9 January 2012). The opined based on the information that he was arrested shortly after his statements against the government and was not tried in a court of law within a reasonable time. His lawyers were also arbitrarily detained. Therefore, his arrest and detention are contrary to the fundamental rights and freedoms, which constitute violations of Articles 9, 10, 11, 18, 19, and 21 of the Universal Declaration of Human Rights and Articles 9, 14, and 19 of the International Covenant of Civil and Political Rights. The Working Group requested the government to release Mr. Tabarzadi immediately and to ensure that he will be compensated for the violation of his right to freedom of arbitrary arrest.

This document contains translated extracts of the instruction by the French judicial police regarding the assassination of Iran's former Prime Minister and opponent to the Islamic Republic, Shapur Bakhtiar and his private secretary, Sorouch Katibeh. On August 6th, 1991, two visitors from Iran and one of the members of Shapur Bakhtiar's political organization, visited him in his house in the town of Suresnes near Paris. During the visit, Shapur Bakhtiar and his secretary were assassinated. The investigation led to the indictment of a number of people linked to the Iranian government. The Persian version is the translation of the indictment issued by the prosecution.
