In this article, written in early 1981, Nasser Katouzian, an eminent Iranian jurist and law professor, argues against Ayatollah Khomeini's theory of the Guardianship of the Religious Jurist. Professor Katouzian rejects the validity of this theory not only from a mondern democratic stand point but more importantly he draws his arguments from religious and sacred texts.
